The specialized seminar titled “Bilateral Loan Restructuring Agreements with Banks & Servicers | Negotiation Strategies & Factors Determining the Restructuring of Business Debts”, organized in cooperation with the Nomiki Bibliothiki, was successfully completed. The speakers at the seminar were the partners of our law firm, George Psarakis and George Kefalas.
The seminar focused on the process of restructuring business loans through bilateral negotiation, namely direct negotiation between the debtor and the bank or claims management company, outside standardized or mass procedures. Particular emphasis was placed on the factors that affect the final structure of a restructuring arrangement, such as the financial position of the business, the value of the collateral, the ability to service the new repayment schedule, the creditor’s stance, and the potential alternative enforcement procedures.
As part of the presentation, practical issues arising during negotiations with banks and servicers were analyzed, as well as the need for proper legal and financial assessment of each restructuring proposal before its acceptance. The formulation of a sustainable agreement is not limited to reducing the monthly instalment; it requires an overall assessment of the contractual terms, the collateral, the consequences of any default, and the debtor’s actual ability to comply in the long term.
