Interim Order of the Athens Court of First Instance on Entry into the Premises and Inventory of Software in the context of Proof of Infringement of Intellectual Property Rights

In the context of a case of illegal copying and commercial exploitation of computer programs, manufactured by our client - the applicant company, following our request, the President of the Athens Single Judge Court of First Instance granted a temporary injunction, which ordered, inter alia, the entry into the premises of the defendant company - the opposing party and further, into its computers and the detailed inventory, description - recording and export of a functional - readable copy of the product of the contested copying. In particular, our client - the applicant company had primarily manufactured and marketed two computer programs, which had been unlawfully copied by the opposing party. By virtue of the aforementioned Provisional Order, the applicant company succeeded in securing the necessary evidence to prove, on its part, the contested infringement of its rights under the Intellectual Property Law (Law 2121/1993), in order to further, in the context of the now proven infringement, to claim from the opposing party the removal of the said infringement and its omission in the future, as well as the payment of compensation.
