4 Appeals Court Decisions that turn the forced collection of red loans by Servicers

The Athens Court of First Instance has issued an interim order suspending the enforceability of two payment orders of approximately EUR 3 million issued following an application by a Credit Institution in Special Liquidation. The latter proceeded with a cheque for enforcement which was served firstly after the discussion of the application for suspension of enforcement and before the judgment was delivered. The court was convinced of the abusiveness of the credit institution's conduct and provided protection to the borrower company by granting an interim order after the suspension application had been discussed but before a decision had been given on it.
